WASHINGTON The Supreme Court came down against double taxation Monday in a case that could cost some states and cities millions of dollars.

The justices sided with taxpayers over governments in a case that tested Maryland's income tax system, which does not grant a full credit to residents who also pay income taxes in states where they work. The state is among the few that collect some income taxes on residents who work out of state.

It was a difficult decision for the justices to reach, taking six months since oral arguments were held for the divided ruling to be issued. That's because both Maryland and one of its residents, Brian Wynne, had good arguments.

From Wynne's point of view, residents forced to pay taxes where they live and where they work are victims of double taxation. From the state's point of view, residents who don't pay as much as their neighbors are getting the same services cheaper.

I agree with the majority, and I think this is a good decision.  I just think it's interesting that Elena Kegan, RBG, Clarence Thomas and Antonin Scalia are the dissenters.  You rarely will see a 5-4 decision with this type of split.

SCOTUS is almost never 9-0.

This court has shown its willingness to favor big corporations over individual and taxpayer rights time and again; thankfully it looks like the individual can still be protected from the state.

I like the ruling for two reasons:

1.  I agree that the only states that should collect income tax are ones where you are a declared resident.  You want tax from non-residents?  That's what sales taxes do.

2.  I like that the justices didn't rule under normal 4 conservative & 4 liberal with Kennedy casting the deciding vote like has become painfully predicable for the last decade.
